SAN ANTONIO - We're hearing from James Brennand for the first time since his arrest for the 2022 shooting of an unarmed teenager. Brennand has waited nearly four years for his day in court. Now, he's feeling a weight off his shoulders over the case's dismissal.
"I think it it's well past due, but I'm very grateful for it," Brennand said.
He's breathing a sigh of relief for the first time in four years after the Bexar County District Attorney dropped the charges against him for aggravated assault by a public servant.
I feel an overwhelming amount of relief for me and my family," Brennand said.
He was arrested and charged after shooting then 17-year-old Erik Cantu; who was sitting in his car in a McDonald's parking lot when Brennand approached him.
Their interaction was caught on bodycam video.
Brennand declined to give his version of the story when asked by reporter Destany Fuller.
In Monday's court hearing, the prosecution asked for a continuance, possibly delaying Brennand's trial date further.
In a statement from the district attorney's office. Officials say there are recent allegations -- including "a recent terroristic threat allegation from July 1, 2026" against Cantu that could have impacted Brennand's trial.
"Those are serious allegations," said Defense Attorney and Managing Partner of LaHood Norton Goss Law Group, Nico LaHood. "They want a time to investigate that. We wanted to move forward..James asserted his right, under the constitution, to a speedy trial."
The continuance was denied. The DA's office saying they could refile charges in the future.
"Do you want your job back? Do you want to be a police officer at all anymore?," we asked Brennand.
"I think all of this is so new and so fresh," he said. "The only thing I'm looking forward to right now is just seeing my son and my fiancée and just spending that time together with my family today and deal with that later."
We reached out to Cantu for comment but haven't heard back.
The former SAPD officer says he's ready to move forward after the criminal charges in the case were dropped.
