GOP divided over next steps in fight against birthright citizenship

The Supreme Court’s Tuesday decision on birthright citizenship, which it upheld against President Donald Trump’s challenge, sent Republicans scrambling for new paths to restrict it.

Some lawmakers proposed a constitutional amendment to replace the 14th, which aims to grant citizenship to most people born in the U.S. Others suggested a federal crackdown on foreign mothers traveling to America only to give their newborns the Constitution’s rights.

More practical Republicans have tended to pursue the latter option, which has a far better, although still uncertain, chance at succeeding.

“Recall for a constitutional amendment to be adopted: A proposed amendment must be passed by two-thirds of both houses of Congress, then ratified by the legislatures of three-fourths of the states,” Senator John Cornyn, the Texas Republican, wrote in a Tuesday afternoon X post.

The Capitol, while currently in Republican control, has been polarized for the past several years. Many states have also become reliably blue or red, with only a few retaining their purple tint.

Democrats are vehemently opposed to restricting birthright citizenship, which was established as a remedy to the South’s practice of denying former slaves constitutional rights in the mid-19th century. House Minority Leader Hakeem Jeffries, celebrating the Supreme Court’s ruling in a statement, committed to fighting any further GOP challenges of the right.

“On the eve of America’s 250th birthday, the far-right MAGA conservatives have failed in their quest to remake the United States, and American values have prevailed,” Jeffries said. “House Democrats will never let these extremists win, and we will always defend our defining values of freedom and democracy.”
